1. Introduction

These Terms of Use govern access to and use of the digital properties operated by Lucky Cement Limited ("Lucky Cement", "we", "us" or "our"). They apply to the Lucky Ustaad mobile application, the Lucky Ustaad web experience available through the Homebuilders Hub, and the Lucky Cement corporate and marketing website, together with any related features, tools, content and services made available through them. In these Terms, all of the above are referred to collectively as the "Services".

By downloading the application, browsing the website or otherwise using any part of the Services, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, please discontinue use of the Services.

2. Who we are and how to reach us

3. Eligibility

4. The nature of the guidance we provide

Lucky Ustaad is a digital assistant designed to make home construction easier to understand. It draws on published construction practice, on reference material prepared by Lucky Cement, and on artificial intelligence systems that generate responses in ordinary language. The calculators, planners, reference tables and conversational responses available through the Services are provided for general information and preliminary planning only.

This is the most important thing to understand about the Services: they do not constitute professional engineering, architectural, structural, surveying, safety or legal advice, and they are not a substitute for the judgement of a qualified professional who has inspected your site. Construction outcomes depend on soil conditions, climate, workmanship, local building regulations, the quality of materials sourced, and many other factors that the Services cannot observe or verify. Quantities, ratios, timelines and cost indications produced by the Services are estimates based on standard assumptions, and actual requirements will vary.

You are responsible for verifying any output of the Services with a qualified engineer, architect or contractor before relying on it, and for obtaining all approvals required by the relevant authorities before beginning or continuing construction work. Automated systems can produce responses that are incomplete, outdated or incorrect, and we do not warrant that any response is accurate or fit for your particular circumstances.

5. Content you submit to the assistant

The Services allow you to type questions, upload photographs from your device, and capture images of a site or material for interpretation. You should submit only content that you own or are otherwise entitled to share, and you should avoid including sensitive personal information, confidential drawings, identity documents or the personal details of others in what you submit.

By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, process, reproduce and analyse that content for the purpose of operating and improving the Services, including by transmitting it to the technology providers that support the assistant. You retain ownership of what you submit. Our handling of personal information contained in your submissions is described in the Privacy Policy.

Conversation history may be retained on your device so that you can return to earlier guidance. Clearing it from the application removes it from your device, and the treatment of any copy held on our systems is set out in the Privacy Policy.

6. Acceptable use

You agree to use the Services lawfully and in good faith. In particular, you should not attempt to interfere with the operation, security or integrity of the Services, use automated means to extract content or overwhelm the systems, reverse engineer or copy any part of the platform, misrepresent your identity or affiliation, submit unlawful, defamatory, obscene or infringing material, use the Services to develop a competing product, or use them in a way that infringes the rights of any other person.

We may suspend or withdraw access where we reasonably believe these Terms have been breached, where continued access presents a security or legal risk, or where we are required to do so by law.

7. Product information, recommendations and advertising

Where the Services present products, whether manufactured by Lucky Cement or by other brands, the associated descriptions, specifications, images and availability are provided for information and may change without notice. Recommendations generated by the Services reflect general suitability for the described use case and should not be read as an assurance of performance, quality, availability or price.

Parts of the Services carry advertising and sponsored placements, including material supplied through third-party advertising networks. Advertisements are identified as such where required. We do not endorse, and are not responsible for, the goods, services, claims or conduct of any advertiser or third-party brand featured through the Services, and any dealing you have with them is between you and them.

Where the Services offer optional promotional mechanics, such as viewing a short video in exchange for access to a feature or benefit, participation is voluntary and the benefit offered is subject to availability, may be withdrawn or varied at any time, and holds no cash value.

8. Dealers, enquiries and referrals

The dealer locator and the enquiry forms allow you to identify stockists and to express interest in purchasing product. Submitting an enquiry does not create a contract of sale and does not guarantee availability, pricing or delivery. Dealers and distributors are independent businesses, and any transaction you enter into with them is a matter between you and that dealer. Location information shown through the locator is provided on a best-efforts basis and may not always reflect current trading status.

9. Careers and recruitment

Where the Services allow you to apply for a role, you confirm that the information and documents you submit are accurate, that they are yours to provide, and that you are entitled to work in the relevant jurisdiction. Submitting an application does not create an employment relationship or any obligation on our part to consider, respond to or progress it. Information submitted through the careers section is handled in accordance with the Privacy Policy and our internal recruitment practices.

10. Intellectual property

All content forming part of the Services, including text, graphics, interface design, photographs, illustrations, video, software, data compilations and the arrangement of the whole, is owned by Lucky Cement or licensed to us and is protected by copyright, trade mark and other intellectual property laws. The Lucky Cement name, the Lucky Ustaad name, the associated logos and the brand identities of our products are our trade marks and may not be used without our prior written permission.

You may view, download and print material from the Services for your own personal, non-commercial use, provided you do not remove any proprietary notices. All other use, including reproduction, distribution, adaptation, public display or commercial exploitation, requires our written consent.

11. Third-party services and links

The Services connect to and rely upon technology and content provided by others, including mapping services, analytics and measurement tools, advertising platforms and artificial intelligence providers, and they may contain links to websites we do not control. Those services operate under their own terms and privacy policies. We are not responsible for their content, availability, accuracy or practices, and the inclusion of a link or an integration does not imply endorsement.

12. Availability and changes

We aim to keep the Services available and functioning, but we do not guarantee uninterrupted access. Availability may be affected by maintenance, upgrades, network conditions, device compatibility, the availability of third-party systems, or events outside our reasonable control. We may add, modify, suspend or discontinue any feature, in whole or in part, at any time, and we may release updates to the mobile application which you may need to install in order to continue using it.

13. Disclaimers

To the fullest extent permitted by law, the Services and all content, tools, calculations and recommendations made available through them are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will meet your requirements, that any output will be accurate or complete, or that the platform will be free of errors, interruption or harmful components.

14. Limitation of liability

To the fullest extent permitted by law, Lucky Cement, its group companies, its officers, employees, contractors and service providers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, business, goodwill, data or anticipated saving, arising out of or in connection with your use of or inability to use the Services, however caused.

Without limiting the above, and to the extent permitted by law, we accept no liability for construction defects, structural failure, material wastage, cost overruns, delays, injury or property damage arising from reliance on guidance, estimates or recommendations obtained through the Services, or from work carried out without appropriate professional supervision.

The Services are made available to you free of charge. Where liability cannot lawfully be excluded, our total aggregate liability in connection with the Services will not exceed PKR [insert amount], or such minimum amount as applicable law requires. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

The Services may be made available in English and Urdu. Translations are provided for convenience. In the event of any inconsistency between versions, the English version prevails for the purposes of interpreting these Terms.

18. Changes to these Terms

We may revise these Terms from time to time to reflect changes in the Services, in our practices or in applicable law. The revised version takes effect when published, and the effective date at the top of this document will be updated accordingly. Where changes are material, we will take reasonable steps to bring them to your attention. Continued use of the Services after publication constitutes acceptance of the revised Terms.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any right does not waive that right. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a reorganisation or transfer of business. These Terms, together with the Privacy Policy and any additional terms we present for a specific feature, constitute the entire agreement between you and us in relation to the Services.

20. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Islamic Republic of Pakistan. The courts at Karachi, Pakistan have exclusive jurisdiction, without prejudice to any right we may have to seek relief in another competent forum for the protection of our intellectual property or confidential information.
